Virginia Hopkins is a great waitress and she’s used to getting great tips. But the one she got from her Uncle Sam on Tuesday nearly knocked her to the floor.

Virginia is owed a tax refund of $754, for which she has been waiting eagerly. But the check she opened was for more. A lot more: $434,712.

“I think I would have to work most of my life to earn that much money,” she says. “Even with undeclared tips,” she adds with a laugh.

Virginia’s tips aside, she is clearly one of the most honest waitresses in the country. She didn’t consider keeping the money even for a moment.

The problem is she didn’t quite know how to go about returning half a million dollars to the U.S. government.

Virginia was on her way to work anyway, so she took the check with her. Virginia has been waiting tables at Johnny’s Downtown Restaurant, a Cleveland institution, since it opened 19 years ago.

“I tell people I used to be a tall, slim brunette,” she jokes. “Now I stand four-feet-eight with white hair. This is what happens after 20 years of waitressing.”

She may not be tall or brunette any more, but she hasn’t lost any of the personality that makes her one of the restaurant’s favorite employees.

“She was laughing” when she brought the check in, says fellow employee Mary Lou Adams, who’s been a bookkeeper at Johnny’s for as long as Virginia has been a waitress. “She said, you’ll never believe what I got in the mail.”

Both workers and diners at the restaurant joined in the discussion of what Virginia should do.

“You have a million new best friends,” Virginia says. “My grandchildren especially. They’re teenagers.” Her grandchildren thought half a million dollars just might get them into the sold-out Cleveland concert of the boy band One Direction.

It was not to be.

It was decided the best plan was for Virginia to hand carry the check into Cleveland’s IRS office the next day.

“Would you believe I had to give them a photo id to prove it was me before I could give it back?” she says. “Otherwise they wouldn’t even talk to me.”

Once she’d convinced them she wasn’t trying to scam the U.S. government by bringing in a large check, she says the IRS people were very polite. They took the check and promised to thoroughly investigate the error.

But Virginia will never learn why she was rich for a day. For privacy reasons, she says, the IRS will not reveal the results of their investigation.

Today is Virginia’s day off. She says she’s spending it “readjusting.”

“It’s not easy being poor after you’ve been rich,” she jokes. But she did get something out of the experience.

A local television reporter happened to be eating at the restaurant when she came in with her riches, so now Virginia is a Cleveland celebrity.

Is she getting better tips?

“Last night was a good night,” she admits. “Please tell me fortune goes with fame.”

Virginia is still waiting for her $754 refund.

Teenager Aaron Deveau insists he was not texting when his car swerved and collided head-on with an oncoming pickup truck on Feb. 20, 2011, but 18 days after the crash, the man he hit died.

Now Deveau is on trial in Haverhill, Mass. in what could be a landmark case in the controversial topic of texting while driving. Deveau now stands accused of killing 55-year-old Donald Bowley.

Prosecutors allege that Deveau, who has pleaded not guilty, was texting the day his vehicle slipped across the center line of a Haverhill street and crashed into Bowley’s truck.

“My brother received such severe head trauma that he had, there was no hope for him,” the victim’s sister Donna Bowley told ABC News.

Deveau was charged with motor vehicle homicide by negligent operation, negligent operation of a motor vehicle, being an operator under 18 using a mobile phone, being an operator reading or sending an electronic message, a marked lanes violation, and two counts of negligent operation and injury from mobile phone use.

Deveau’s lawyer has said there is no evidence the crash caused Bowley’s death, while Deveau told police he swerved to avoid a vehicle in front of him that slowed down, according to ABC News Boston affiliate WCVB.

Luz Roman, who was dating Bowley, also suffered serious injuries in the crash. When she took to the stand earlier this week, she broke down as she talked about being in the truck with Bowley that day.

“This is a miracle that I’m here,” Roman told the court.

Prosecutors contend Deveau was not paying attention when the vehicles collided. Police say he received two messages: one at 2:34 p.m. and a second at 2:35 p.m., on the day of the crash. Prosecutors say the accident happened at 2:36 p.m.

“The defendant sent and received 193 texts on Feb 20, 2011,” a prosecuting attorney in the case told the court.

In a videotaped statement recorded after the crash, Deveau, then 17, had a question for police: “If anything happens to them, if one passes away, what would happen to me?”

Texting while driving is a crime in Washington, D.C. and 38 states, including Massachusetts.

Many advocates of bans on texting while driving want to see the number of states outlawing it expand.

“I would like to see cell-phone use banned in all 50 states,” said one advocate, Rob Reynolds. “We want to make this as socially unacceptable as like smoking has become in public places.”

If convicted Deveau will face two years in prison. On the count of motor vehicle homicide, he faces sentence of up to 2½ years.

The man killed whose body parts were mailed to Canadian political parties was a Chinese student, according to police, as French authorities searched for the suspect, Canadian porn actor Luka Rocco Magnotta.

1 June 2012         11:27 ET

French police are searching for a Canadian porn actor wanted for the murder and dismemberment of his lover.

Luka Rocco Magnotta, 29, is thought to have flown from Montreal to Paris last weekend, say French police officials.

The suspect’s alleged victim was Jun Lin, a 33-year-old Chinese student, Montreal police told the BBC.

A hand and a foot were posted to political parties in Ottawa on Tuesday and a headless torso was found behind Mr Magnotta’s Montreal flat.

Although results have not yet emerged from forensic tests on the remains, police say they are all but certain the body parts were Jun Lin’s.

Interpol issued a Red Notice wanted-persons alert on Thursday for Mr Magnotta.

Canadian police said they suspected he may have left the country based on evidence found during a search of his flat, and a blog post he wrote about how to disappear.

Dead kittens

A senior French police official told the Associated Press news agency he was certain that Mr Magnotta was currently in France.

But another French police source told AFP news agency: “French police have no certainty about his presence or not in France.”

Jun Lin, from the city of Wuhan, in China’s Hubei province, was a student at Montreal’s Concordia University. He was reported missing the day before his remains were discovered.

On Tuesday a foot was posted to the Conservative Party’s offices, and police intercepted a second parcel, containing a hand, addressed to the Liberal Party’s offices.

One of Prime Minister Stephen Harper’s political advisers opened the bloodstained box containing the foot.

A video posted online that appears to show a man using an ice pick to kill another man was believed to show Jun Lin’s murder, investigators say.

The suspect, also known as Eric Clinton Newman and Vladimir Romanov, had reportedly worked as a bisexual porn actor and model.

Media reports have linked Mr Magnotta to a video posted online in 2010 that showed two kittens being placed in a plastic bag and suffocated, and another of a kitten being fed to a snake.

Police described him as a white male, about 5ft 8in (1.73m) tall with blue eyes and black hair.

So you’re thinking of joining the Vanderbilt football staff. You have a great resume, experience and talent. But getting a job on James Franklin’s staff isn’t about any of those things, it’s about how attractive your wife is.

Franklin unabashedly said so during a radio interview Wednesday where he claimed that one of the first things he does when looking at perspective hires is size up their wives.

Yeah, creepy.

“I’ve been saying it for a long time, I will not hire an assistant coach until I’ve seen his wife. If she looks the part, and she’s a D-I recruit (one of the nation’s best-of-the-best), then you got a chance to get hired. That’s part of the deal.”

So where did Franklin acquire all the Manswers? Well, from the movie “Moneyball” in which a scout quips: ”Ugly girlfriend means no confidence.”

“There’s a very strong correlation between having confidence going up and talking to women, and being quick on your feet and having some personality and confidence and being fun and articulate, than it is walking into a high school and recruiting a kid and selling him.”

On Thursday, Franklin responded to his comments on Twitter with more embarrassment than apology:

“My foot doesn’t taste good, I hope I did not offend any1, I love & respect ALL,have a great day, enjoy the fam & don’t forget 2 #AnchorDown”

Franklin isn’t the first coach to lay out criteria for his coaching staff. In January, South Carolina coach Steve Spurrier said he didn’t want fat, sloppy, smoking bachelors gracing his coaches room. But it’s got to be awkward for a prospective assistant to present his wife to Franklin as eye candy before he can be considered for a position that may or may not include fetching coffee.

So take heed prospective Vandy applicants, if your wife looks like she belongs on the cover of Martha Stewart Living instead of Maxim, find another place to apply.

Oh, and if you want to see what Franklin’s hotness scale, you can find all the family photos from last year’s staff under the “Football Coaches and Staff” section of the media guide.
