The woman who accused Greg Kelly of raping her also claims she became pregnant as a result of the alleged sexual assault, sources told DNAinfo.

Kelly, a local TV news anchor and son of NYPD Commissioner Ray Kelly, is being investigated by the Manhattan District Attorney’s office after the woman walked into the 13th Precinct Tuesday night and claimed he raped her in her law office near South Street Seaport.

The accuser, who is not a lawyer, told police that she was virtually passed out when Kelly, the co-host of Fox 5′s “Good Day New York,” allegedly sexually assaulted her last Oct. 8 at her Wall Street-connected firm.

The woman, in her late 20s, said she and Kelly, 43, met for the first time that evening and they were drinking at a bar near the Seaport.

They then strolled to her office where she claimed the newsman assaulted her while she was incapacitated.

She told investigators she eventually called Kelly demanding to know “what did you do to me?” sources said.

Kelly, through his attorneys, has vehemently denied the allegation. His lawyers have turned over text messages between Kelly and the woman that they believe undermine suggestions the encounter was anything but consensual.

She was described as a credible “professional person” who said she ended her pregnancy, sources said. After the woman made the accusation, the NYPD quickly contacted the Manhattan District Attorney’s office to take over the investigation because of the conflicts created for cops who would have to investigate the police commissioner’s son. He has not been charged with any crime.

Kelly was absent from Thursday morning’s “Good Day New York” broadcast.

“Mr. Kelly is aware that the New York County District Attorney’s office is conducting an investigation,” Kelly’s lawyer Andrew M. Lankler said in a statement.

“Mr. Kelly strenuously denies any wrongdoing of any kind, and is cooperating fully with the District Attorney’s investigation. We know that the District Attorney’s investigation will prove Mr. Kelly’s innocence.”

The alleged victim told investigators that her boyfriend became enraged when she told him about the alleged attack, sources said. He confronted the police commissioner at a public event around the holiday season and told him that his son had ruined her life, a police spokesman said Wednesday.

Ray Kelly told the boyfriend to write him a letter, the woman told investigators, sources said.

Bloomberg, speaking at an unrelated press conference, said Ray Kelly took the appropriate step when he told the accuser’s boyfriend to write a letter.

He also said turning the case over to the DA was “exactly what they should do,” and added that “as far as I know, Greg Kelly has not been charged with anything.”

The NYPD referred all calls to the district attorney’s office. The DA’s office also declined to comment.

U.S. officials on Wednesday were providing some new details on the dramatic helicopter rescue of an American aid worker and her Danish colleague in Somalia.

The Pentagon released a statement Wednesday morning on the U.S. military’s rescue, saying that Jessica Buchanan, 32, and Poul Hagen Thisted, 60, were not hurt in the operation.

The Pentagon also said there were no injuries to any of the U.S. troops involved. It also noted that the FBI was involved in the rescue.

 The commandos that carried out the operation were drawn from the same Navy SEAL team involved in the mission that killed Osama bin Laden, according to the Associated Press. [Updated 9:31 a.m.Jan. 25: A U.S. official confirmed to The Times that the rescue was carried out by SEAL Team 6.]

Nine Somali hostage-takers were killed in the operation, and five others were wounded, witnesses in Somalia told the Los Angeles Times. [Updated 9:31 a.m. Jan. 25: A U.S. official said the raid occurred in the village of Hiimo Gaabo, south of Galkayo, where Buchanan and Thisted had been kidnapped by a gang of gunmen last October.]

Defense Secretary Leon E. Panetta said in a statement that the rescued aid workers were “transported to safe location, where we will evaluate their health and make arrangements for them to return home.”

[Updated 9:31 a.m. Jan. 25: The team parachuted into the vicinity of the camp where the two hostages were being held and carried out the assault, the officials said.

The Pentagon decided to move after recently receiving intelligence on Buchanan and Thisted’s location. The decision to carry out the rescue now was made in part because of concerns that Buchanan’s health might have been deteriorating, the officials said.

“We had indications that she had health issues when they were kidnapped and that certainly contributed to the sense of urgency,” the officials said.]

Buchanan and Thisted, both from the Danish Demining Group, had been kidnapped in October in the central Somali town of Galkayo, which until then had been considered relatively safe for Westerners.

The pre-dawn raid was carried out by U.S. military helicopters and Navy SEALs operating out of an American base in the tiny East African nation of Djibouti, U.S. officials said. Witnesses said the operation took place after 2 a.m. local time and lasted about 15 minutes.

After the mission, officials said, the SEALs flew Buchanan and Thisted to the Djibouti base, Camp Lemonnier, where about 2,500 U.S. personnel are stationed.

President Obama appeared to refer to the mission just before the State of the Union address Tuesday night when he pointed at Panetta, and said, “Good job tonight. Good job.”

In a statement early Wednesday, the president praised the SEALs for their courage and warned that the U.S. would not tolerate kidnappings of Americans.

“As commander in chief, I could not be prouder of the troops who carried out this mission, and the dedicated professionals who supported their efforts,” he said.

“Jessica Buchanan was selflessly serving her fellow human beings when she was taken hostage by criminals and pirates who showed no regard for her health and well-being.

“The United States will not tolerate the abduction of our people, and will spare no effort to secure the safety of our citizens and to bring their captors to justice.”

Obama said that in a telephone conversation with Buchanan’s father Monday night he “told him that all Americans have Jessica in our thoughts and prayers” and that she “will soon be reunited with her family.”

The October kidnapping was one of a series of abductions by Somali pirates in a bid to extort high ransoms, with Westerners fetching the highest prices. Several kidnappings occurred late last year in Kenya, Somalia’s southern neighbor, triggering a Kenyan invasion in a bid to restore a stable government, an effort that continues to this day.

The U.S. has built up its military presence around Somalia in recent years, deploying surveillance drones, special operations units and ships off the coast, as part of a strategy to keep tabs on militants in the lawless country and pirates who regularly hijack ships off its coast.

U.S. officials are especially worried about Al Shabab, an Islamic militant group with ties to Al Qaeda that has taken control of large parts of southern Somalia. The group has often threatened Western aid groups in Somalia, though it has also allowed some organizations to provide assistance over the last year as famine afflicted the country.

The 1991 singles ad in an Orange County, California magazine was as salacious as it was straightforward. “I know how to take care of my man if he knows how to take care of me. Wealthy men only,” it read. Included with the ad was a photo of a sexy young woman wearing even sexier lingerie. For 54-year-old Bill McLaughlin, a newly divorced millionaire businessman from Newport Beach, it was a perfect fit.Click here to find out more!

After he met 28-year-old Nanette Ann Johnston, McLaughlin fell hard and the two began dating. Within a few months, the California beauty had moved into his home in the gated community of Balboa Coves in Newport Beach, just a stones throw from the Pacific Ocean.

Three years later, on the evening of December 15, 1994, McLaughlin was dead. The man who made his fortune by inventing a device that filters blood was shot six times in his kitchen as he was making a sandwich. Upstairs, his 24-year-old mentally disabled son heard the shots and called 911. Police suspected Johnston in the murder and fingered former National Football League linebacker Eric Naposki, who she was seeing on the side, as the triggerman, but the two were never arrested.

Now, more than 16 years later, Naposki, a 44-year-old Connecticut personal trainer and father of two, is going on trial for the cold-case murder of McLaughlin. Johnston, now 45 and remarried with four children, will have her day in court later this summer. Opening arguments in Naposki’s trial begin today.

Both are accused of scheming to get rid of McLaughlin, driven by greed so they could collect a chunk of the wealthy businessman’s considerable fortune. Johnston, who prosecutors believe was the mastermind, stood to inherit a $1 million life insurance policy and $150,000 from McLaughlin’s will. Plus, in the event of McLaughlin’s death she would have the right to live in his beach house for one year. Naposki, a dead-beat dad who squandered his NFL salary long ago, was desperately looking for a big payday.

The sensational crime rocked the wealthy Orange County coastal community. On the day of his death, McLaughlin had returned from a business trip to Las Vegas on his private plane. When he arrived home, he found a note from Johnston informing him that she was attending her son’s soccer game. Around 9 p.m., as McLaughlin was making a sandwich, an intruder snuck into his home using a brand new key and plugged six bullets into his chest.

The police arrived soon afterwards and found part of the key stuck in the front door — the killer had inadvertently snapped it in half as he was trying to gain entrance. Lying on the doormat was another key that allowed entrance into the complex. Two 9 mm casings were discovered in the kitchen next to McLaughlin’s lifeless body.

“Around 9 p.m., as McLaughlin was making a sandwich, an intruder plugged six bullets into his chest.

By the time Johnston arrived home, the house was full of detectives. She told them she spent time at her son’s soccer game in the city of Walnut and later went Christmas shopping. Her ex-husband, who also attended the game, could vouch for her whereabouts, she said.

But when police went to confirm this with Johnston’s ex-husband they were surprised to learn that Johnston showed up to the game with none other than Eric Naposki. Investigators began looking into rumors that the two were secretly dating, and soon learned that the couple met at the Sporting Club Irvine in the winter of 1994 and started a relationship soon afterward. Naposki, who grew up in New York, was a college football star before he got drafted into the NFL. He played two seasons with the New England Patriots and one season with the Indianapolis Colts. Then he moved to Europe and played four seasons with the Barcelona Dragons.

Around 1993, he moved to Orange County and worked as a personal trainer before starting a security business called Coastal Elite Security, which provided security guards for apartments. He later got a job at the Thunderbird Nightclub, 131 yards from McLaughlin’s home. According to prosecutors, by the time he met up with Johnston, he was deep in debt.

“He didn’t have much money,” Naposki’s defense attorney Gary Pohlson told The Daily Beast. “He wasn’t some wealthy guy. There were child support issues. He was trying hard to pay his bills and get ahead.”

About their relationship, Pohlson said, “[Naposki] was in love with Nanette. She was real athletic and he was a jock.”

She was also a gold-digger with a history of lying — Johnston was forging checks out of McLaughlin’s bank account months before the murder. Within 24 hours of his death, she cashed three more checks totaling $355,000. After McLaughlin’s death, she racked up his credit card bill and purchased $600 alligator-skin boots for Naposki.

Investigators couldn’t find the gun that was used to kill McLaughlin, but they did find out that Naposki owned two handguns: a .380 caliber pistol and a 9 mm Beretta. He purchased the Beretta four months before the slaying but loaned it to a friend, he told the police. But when the cops tracked down the friend, they discovered the gun Naposki gave him was a .380 caliber pistol, not a Beretta. What’s more, an employee who worked at a hardware store near Naposki’s apartment told detectives that he constructed a silencer for a Beretta for Naposki, ostensibly for use in a movie shoot.

The investigators’ case was coming together. They found evidence that the lovebirds were house-hunting in July in Turtle Rock, a tony neighborhood in Irvine. A realtor told detectives that the couple told her they planned to move into a new home in the spring of 1995, three months after the murder. But despite the mounting evidence, Johnston has repeatedly denied she had anything to do with McLaughlin’s death. In a 1995 interview with the Los Angeles Times, she told a reporter that she “didn’t do it and [Naposki] didn’t do it… I don’t think they [police] have any real facts. They couldn’t, because I didn’t do anything… I stood to gain a lot more by being with Mr. McLaughlin than [from] an insurance policy.”

Six months after the murder, Johnston and Naposki split, said Pohlson, Naposki’s defense attorney. “Nanette was getting charged with a crime and [Naposki] found out there was more to their relationship than she told him so he decided to forget it,” he said. “He never met Bill. He never was in his house. [Nanette] told him Bill was her boss. After the murder it was all over the paper she was Bill’s fiancé.”
In March of 1996, Johnston pleaded guilty to stealing nearly $500,000 from McLaughlin before and after his death. She was sentenced to one year in jail.

Two years later, a woman who lived in the same apartment complex as Naposki contacted the Newport Beach police to report that Naposki had made troubling statements about McLaughlin prior to his death. Although four years had passed, the woman recalled that Naposki had confided in her that he was angry because McLaughlin had tried to force himself on Johnston. He allegedly told her, among other things, to deny that she knew him if she was ever questioned by the police.

Detectives brought the case to Orange County prosecutors but were told that there wasn’t enough evidence to file charges. There was no smoking gun. The case languished for more than a decade until Orange County senior deputy district attorney Matt Murphy, who specializes in complicated murder cases, reopened it. In May of 2009, after pouring over the dusty files and old evidence, re-interviewing eyewitnesses, and looking into new leads, Murphy decided he had enough evidence to prosecute the former lovers.

By the time they were arrested, Naposki was living in Connecticut and engaged to be married to a schoolteacher. Johnston had remarried and changed her last name to Packard, and had just given birth to a boy. She was living the life of a soccer mom in Ladera Ranch, a picturesque community north of San Diego.
Last week, Pohlson provided some glimpses into the defense’s case. He told The Daily Beast that the Orange County District Attorney’s case is weak and that Naposki has an alibi for the night of the murder. According to Pohlson, Naposki made a phone call from a payphone 12 miles away from the murder scene at 8:52 p.m. He couldn’t possibly have made it to McLaughlin’s house in the Christmas traffic for 9:09 p.m. when McLaughlin’s son made the 911 call.

Pohlson said there are plenty of theories about who really killed McLaughlin. He said McLaughlin had recently won a $9 million lawsuit over a dispute with his business partner. “They were involved in a big lawsuit that had gone on for along time in McLaughlin’s favor, “ he said.

“From my point of view the evidence hasn’t changed,” says Pohlson. “It is a totally circumstantial case.”

Prosecutor Matt Murphy disagrees. During jury selection last week, Murphy argued that “the idea that circumstantial evidence is somehow bad evidence is a very commonly believed myth. But it is a myth. The law is crystal clear on that.”

A former NFL linebacker was found guilty Thursday of shooting a wealthy Newport Beach businessman to death in his seafront home in a plot to collect on a $1 million life insurance policy.

Eric Naposki, a onetime linebacker with the New England Patriots and Indianapolis Colts, allegedly plotted William McLaughlin’s murder with the businessman’s fiancee, Nanette Ann Packard.

The slaying had been one of the more perplexing unsolved homicides in Orange County until Naposki and Nanette Ann Packard were arrested in 1999.

The ex-football player, who at the time of the slaying was working as a bouncer at the Thunderbird Nightclub in Newport Beach, was accused of entering McLaughlin’s home with a key Packard had provided and then shooting McLaughlin, 55, six times in the chest.

McLaughlin’s 24-year-old son, upstairs at the time of the shooting, told police he heard the shots and then found his father’s body. He said the intruder, however, was gone.

The case went cold until police said they uncovered evidence that linked Packard and Naposki the killing.

McLaughlin’s violent death shocked the normally quiet Balboa Coves community where he was a fixture. The businessman was well known in medical circles after inventing a prototype blood-filtering device for collecting plasma.

Packard is also charged in her fiance’s death and is expected to stand trial later this summer. She has already pleaded guilty to theft and forgery for taking nearly $500,000 from McLaughlin’s bank accounts, including cashing a $250,000 check the day before he was shot.

Authorities said Packard and Naposki were romantically involved at the time of the incident.

U.S. Sen. Mark Kirk has suffered a stroke and underwent surgery today at Northwestern Memorial Hospital, his office said.

“On Saturday, Senator Kirk checked himself into Lake Forest Hospital, where doctors discovered a carotid artery dissection in the right side of his neck,” his office said in a statement.

“He was transferred to Northwestern Memorial Hospital in Chicago, where further tests revealed that he had suffered an ischemic stroke,” it said. “Early this morning, the senator underwent surgery to relieve swelling around his brain stemming from the stroke. The surgery was successful.

“Due to his young age, good health and the nature of the stroke, doctors are very confident in the Senator’s recovery over the weeks ahead.”

The office released no other details.

Kirk, 52, captured President Barack Obama’s old U.S. Senate seat in a close 2010 election against Democrat  Alexi Giannoulias.

His victory capped a tumultuous political fight that began when former Gov. Rod Blagojevich was charged with attempting to sell the Senate seat for personal gain – a charge he was convicted of last year.

During 10 years in the U.S. House before his Senate election, Kirk has forged a reputation as a centrist Republican.

He has sought to maintain that reputation amid the bitter partisan atmosphere in Washington, including working together with Democratic Majority Leader Dick Durbin, Illinois’ senior U.S. senator. Kirk recently endorsed Mitt Romney for the Republican nomination for president.

Kirk, who lives in Highland Park, is divorced and has no children.

Canadian freestyle skier Sarah Burke died Thursday of cardiac arrest after sustaining serious injuries following a skiing accident on Tuesday, Jan. 10.

Burke died at the age of 29 in hospital in Salt Lake City, Utah after tearing the artery that supplies blood to her brainstem during a training run in the superpipe while at a personal sponsor event at the Park City Mountain resort.

As the result of the crash, she suffered a ruptured vertebral artery, one of the four major arteries supplying blood to the brain. This caused her to go into cardiac arrest.

Emergency personnel responded and CPR was administered on the scene during which time she remained without a pulse or spontaneous breathing.

Burke was rushed to hospital, where she was put on life support and therapeutic hypothermia was initiated to protect her brain. On Wed. Jan. 11, she had surgery to repair the torn artery, and had been in a medically induced coma until she passed on Thursday morning.

After the operation, tests showed that Burke had sustained severe irreversible damage to her brain due to lack of oxygen and blood after cardiac arrest. This brain damage from lack of oxygen was ultimately fatal.

She passed away peacefully surrounded by those she loved. In accordance with Sarah’s wishes, her organs and tissues were donated to save the lives of others.

Burke’s publicist, Nicole Wool released a statement on Thursday afternoon.

“The family expresses their heartfelt gratitude for the international outpouring of support they have received from all the people Sarah touched,” the statement said.

“Our hearts go out to Sarah’s husband Rory and her entire family. It’s difficult for us to imagine their pain and what they’re going through. Sarah was certainly someone who lived life to the fullest and in doing so was a significant example to our community and far beyond. She will be greatly missed by all of us at the CFSA and the entire ski community,” Canadian Freestyle CEO Peter Judge said in a statement also released on Thursday afternoon.

Legendary life

Burke’s love of freestyle skiing started early. As a teenage moguls skier in Midland, Ont., she’d often sneak onto snowboard halfpipes for the last runs of the day.

“We did it on the last run so that if we got our tickets pulled we wouldn’t be too bummed, ” she once told ESPN.

Burke went from an unwanted pest on the halfpipe to one of its biggest stars and advocates, winning Winter X Games gold medals and lobbying for the sport’s inclusion in the 2014 Olympics in Sochi, Russia.

Burke, who lived in Whistler, B.C., will go down as one of the legends of her sport.

Born in Barrie, Ont., and raised in Midland, Burke got her start skiing with her family when she was five years old. She took up moguls skiing and competed for Team Ontario before switching to freestyle and winning the halfpipe competition at the 2001 U.S. Open of Freeskiing.

Burke won four gold medals in superpipe at the Winter X Games and an additional gold in the event at the Wi nter X Games Europe, having swept both competitions in 2011. She was the early favourite for the event’s Olympic debut.

She also won the 2005 world championships, was the first woman to land a 1080-degree spin (three full rotations) in competition and won the 2007 ESPY award as Best Female Action Sports Athlete.

Along with her accomplishments on the slopes, Burke will also be remembered for her fierce advocacy for halfpipe skiing’s addition to the Olympics.

“She’s been a pioneer,” said Peter Judge, CEO of the Canadian Freestyle Ski Association. “She was really one of the people that started out and led the sport in its very infancy and she rose to prominence very quickly and continued to ride that wave from the standpoint of trying to push the boundaries of the sport.”

Though she was unsuccessful in getting halfpipe included in her hometown Olympics in Vancouver, Burke continued to be a driving factor in the sport’s inclusion in the 2014 Games.

“We’ve been fighting for years [and] it’s not been an easy road,” she told CBC reporter Teddy Katz on April 5, 2011 after the announcement was made.

“I woke up checking my phone a lot and keeping my fingers crossed. I knew it was looking good but you feel a little nervous. But finally when we heard that it was in, [I] was jumping for joy.”

Burke leaves behind her husband, fellow skier Rory Bushfield.

In her first television interview since the 1999 divorce, to be broadcast tonight on Nightline, Marianne Gingrich, a self-described conservative Republican, said she is coming forward now so voters can know what she knows about Gingrich.

In her most provocative comments, the ex-Mrs. Gingrich said Newt sought an “open marriage” arrangement so he could have a mistress and a wife.

She said when Gingrich admitted to a six-year affair with a Congressional aide, he asked her if she would share him with the other woman, Callista, who is now married to Gingrich.

“And I just stared at him and he said, ‘Callista doesn’t care what I do,’” Marianne Gingrich told ABC News. “He wanted an open marriage and I refused.”

Marianne described her “shock” at Gingrich’s behavior, including how she says she learned he conducted his affair with Callista “in my bedroom in our apartment in Washington.”

“He always called me at night,” she recalled, “and always ended with ‘I love you.’ Well, she was listening.”

All this happened, she said, during the same time Gingrich condemned President Bill Clinton for his lack of moral leadership.

She said Newt moved for the divorce just months after she had been diagnosed with Multiple Sclerosis, with her then-husband present.

“He also was advised by the doctor when I was sitting there that I was not to be under stress. He knew,” she said.

Gingrich divorced his first wife, Jackie, as she was being treated for cancer. His relationship with Marianne began while he was still married to Jackie but in divorce proceedings, Marianne said.

While she had been quoted earlier as saying she could end his career, Marianne Gingrich defended Newt’s ethics while he served in Congress and came under several ethics investigations.

“At the time, I believed him to be ethical,” she said in the interview.

The former Mrs. Gingrich says Newt began to plan a run for President at the time of the divorce and told her that Callista “was going to help him become President.”

In a statement to ABC News provided by the campaign, Gingrich’s two daughters from his first marriage said, “The failure of a marriage is a terrible and emotional experience for everyone involved.”

The daughters, Kathy Lubbers and Jackie Cushman said they would not say anything negative about Marianne and said their father “regrets any pain he may have caused in the past to people he loves.”

Marianne Gingrich said Newt has never expressed any such regrets or apologized to her.

Gingrich declined to comment to ABC News for this report, but told NBC’s Today Show Thursday morning he would not “say anything negative about Marianne.”

“Now, I’ll let my daughters speak for it… I’m not going to comment beyond that because I’m focused on the big issues that concern the American people, which are the current challenges we have, largely because of the failure of the Obama presidency,” he said.

Gingrich has said during the campaign he has “no relationship” with Marianne.

Do not try to look up “Internet Censorship” or “SOPA” or “PIPA” on Wikipedia, the giant online encyclopedia, on Wednesday. SOPA and PIPA are two bills in Congress meant to stop the illegal copying and sharing of movies and music on the Internet, but major Internet companies say the bills would put them in the impossible position of policing the online world.

Wikipedia’s founder, Jimmy Wales, says his site will go dark for the day on Wednesday, joining a budding movement to protest the two bills.

“This is going to be wow,” Wales said on Twitter. “I hope Wikipedia will melt phone systems in Washington on Wednesday. Tell everyone you know!”

Several sources said members of Congress, reacting to the online objections, were pulling back on parts of SOPA and PIPA to which Internet companies object. But the protest movement continued for the time being.

Other sites, such as Reddit and Boing Boing, have already said they would go dark on Wednesday. And some of the biggest names online, including Google, Facebook, Twitter and Tumblr, have vocally opposed the proposed legislation, though they have not said they are joining the online blackout.

Google today said it would highlight the issue with a link Wednesday on its home page in the U.S. “Like many businesses, entrepreneurs and web users, we oppose these bills because there are smart, targeted ways to shut down foreign rogue websites without asking American companies to censor the Internet,” said a Google spokesperson.

PIPA, the Protect IP Act in the Senate, and SOPA, the Stop Online Piracy Act, have been presented as a way to protect movie studios, record labels and others. Supporters range from the Country Music Association to the U.S. Chamber of Commerce.

But the Internet giants say the bills could require your Internet provider to block websites that are involved in digital file sharing. And search engines such as Google, Yahoo and Bing could be stopped from linking to them — antithetical, they say, to the ideal of an open Internet.

“If you want an Internet where human rights, free speech and the rule of law are not subordinated to the entertainment industry’s profits, I hope you’ll join us,” said Cory Doctorow of Boing Boing.

Wikipedia, the sixth most visited site in the world, said its English version will be dark for 24 hours Wednesday, urging users to contact Congress. Other joiners of the movement include Mozilla, which offers the Firefox Web browser; the WordPress blogging site; and TwitPic, which allows Twitter users to post images online.

The House bill is on hold for now, and Sen. Patrick Leahy (D.-Vt.), who sponsored the Senate version, said he would be in favor of further research on provisions that have raised objections from Internet service providers. TheWhite House over the weekend said it had reservations about the approach the two bills take.

“While we believe that online piracy by foreign websites is a serious problem that requires a serious legislative response, we will not support legislation that reduces freedom of expression, increases cybersecurity risk, or undermines the dynamic, innovative global Internet,” wrote three White House managers, including Aneesh Chopra, the U.S. Chief Technology Officer.

“Any effort to combat online piracy must guard against the risk of online censorship of lawful activity and must not inhibit innovation by our dynamic businesses large and small.”

It has become a battle pitting Hollywood against Silicon Valley — movie studios and music publishers want to stop the theft of their creative work, but Internet companies do not want to be cast as the police force.

“There isn’t one technology company or venture capitalist who supports these bills,” said Markham Erickson, the executive director of NetCoalition, a trade group for Internet firms, in an interview with ABC News.

“An ‘Internet blackout’ would obviously be both drastic and unprecedented,” NetCoalition said in a statement. “We hope that the Senate will cancel its scheduled vote on PIPA so that we can get back to working with members on how to address the concerns raised by the MPAA [Motion Picture Association of America] and others without threatening our nation’s security or future innovation and jobs.”

The heads of major Internet companies say they grant that music publishers and Hollywood studios have a real problem: People are stealing their music and movies, making digital copies that are as crisp and clear as the originals, and offering them for download, often from overseas websites.

The music and film industries say they consider that a major threat, even a decade after Napster made online file sharing a major issue.

“More than 2.2 million hard-working, middle-class people in all 50 states depend on the entertainment industry for their jobs and many millions more work in other industries that rely on intellectual property,” Michael O’Leary of the Motion Picture Association of America said in a statement. “For all these workers and their families, online content and counterfeiting by these foreign sites mean declining incomes, lost jobs and reduced health and retirement benefits.”

But the devil is in the details, said NetCoalition’s Erickson.

“This bill reverses the policy that has been in place since the beginning of the Web,” he said, “that Internet companies shouldn’t be liable, nor should they be required to police or snoop on their users.”

Francesco Schettino, the Costa Concordia captain at the centre of one of Italy’s worst maritime disasters, is currently under arrest.

He faces possible charges of manslaughter, causing a shipwreck and abandoning ship, charges he denies.

The 52-year-old’s life has been dominated by the sea.

Born in the coastal town of Castellammare di Stabia, near the southern city of Naples, he attended a nautical institute in the nearby town of Piano di Sorrento.

Few personal details are known about Mr Schettino, and his family – based in the Naples town of Meta – have said they are no longer giving interviews to the press.

‘Serious errors’

But speculation is swirling about how the vast ship he captained – almost a floating city with its 4,300 passengers and crew members – ended its journey aground and on its side, metres from the Tuscan island of Giglio.

Mr Schettino joined Costa Cruises in 2002, initially as an official in charge of security. He was promoted to the role of captain in 2006, having been second-in-command.

As reports of a unplanned change of course and a terrifying and chaotic evacuation process have multiplied, the firm has been quick to distance itself from the captain who, it said, had made “serious errors of judgement”.

Costa’s Chief Executive Officer Pier Luigi Foschi said Mr Schettino changed a pre-programmed route to make a manoeuvre that was “unauthorised, unapproved and unknown to Costa”.

“The captain has the authority to take the decisions on board. In this case, the captain decided to change the route and he went into waters that he did not know in advance,” Mr Foschi said.

Disbelief

Italian newspapers have speculated that the change of course may have been a daring deviation, a kind of maritime tribute to one of the crew members who was from the small island.

The reason for the dramatic shift in route will only be revealed by the criminal investigation but, in a television interview given hours after the ship capsized, Mr Schettino’s shock and disbelief is clear.

“I firmly believe that the rock was not shown,” he tells the reporter, seemingly incredulous at what had happened.

“We didn’t hit it with the bow of the boat, but from the side, as if this rock had some kind of spike beneath the water. I don’t know if it was picked up or not but on the nautical chart it said that we should have had deep water beneath us. [...] We were about 300 metres from the rocks, more or less, we shouldn’t have hit anything,” he said.

Calling Mamma

An earlier interview was full of confidence in his abilities and the technology that underpins modern cruise ship travel. But some of his words may come back to haunt him.

“I wouldn’t want to be the captain of the Titanic, forced to navigate between icebergs,” he told a reporter from Czech newspaper Dnes in 2010.

“But I think that with the right preparation any situation can be overcome and any problem prevented,” he added.

When asked whether the 1997 film Titanic had discouraged people from going on a cruise, his response was: “Luckily, people forget tragedies quickly. It’s like plane crashes. Everyone thinks that it couldn’t happen to them.”

As the accusations against Mr Schettino grow, there have been those who have come to his defence, setting up a Facebook page with 1,500 fans.

Many of them are sailors themselves who have commented on how Mr Schettino’s decision to steer the ship towards port after it collided with the rock had probably saved dozens of lives.

According to an interview in Naples-based Il Mattino newspaper quoting his sister, the first person Mr Schettino called after the incident was his 80-year-old mother, Rosa.

The Costa Concordia’s captain did abandon ship before hundreds of his passengers, it has emerged via a transcript of a conversation between him and the local coastguard.

Francesco Schettino, who will be questioned today by investigating magistrate Valeria Montesarchio, also lied to the Captain of the Port of Livorno’s Coastguard when asked how many people were on board the sinking liner, Italian media reported today.

He initially replied ’40′, when there were actually hundreds still at risk, and when further questioned admitted he was not even there.

He then ignored an order to go back onto the sinking ship – with some reports suggesting he volunteered to return, but only to pick up the black box.

The publication of the transcripts by Il Fatto Quotidiano newspaper comes as it was revealed junior officers onboard led a ‘mutiny’ after the ship struck a reef and captain Francesco Schettino dithered in giving the order to abandon the stricken vessel.

According to coastguards Schettino did not give the crucial instructions until 10.58pm on Friday night, more than one hour after the initial impact with the rocks, and so wasting valuable time that contributed to the loss of six lives.

Officials say that during those chaotic minutes, the bungling skipper had tried to palm them off and minimise the dangerous situation it was facing – and that it was his juniors who realised the impending disaster and ordered passengers and crew to the lifeboats.

Proof of the ‘mutiny’ came from coastguard vessels at the scene, who reported seeing several lifeboats in the water before Schettino had officially given the order at just before 11pm.

Italian authorities believe the fact that so many lifeboats were seen in the water in the water just ten minutes after Schettino had ordered them to be launched is proof that they had already been lowered before his command.

A Coastguard source said: ‘Ten minutes is just not enough time to have launched the number of boats that were seen in the water. That’s why we believe that once the ship had started to list, crew members realised the seriousness of the situation and ordered passengers to the lifeboats ahead of the captain giving the order.’

The latest claims follow the publication of transcripts of several heated conversations between coastguards and Schettino, which purportedly took place on Friday night. The first call to the boat took place at 9.49pm, where the coastguard asked what the situation was. The boat had run aground some 30 minutes before.

They did not speak again until 0.42am, when Schettino was asked how many people were on board. He replied ’40′. The coastguard, surprised, asked how there were so few people left on board, and Schettino replied: ‘I’m not on board because we have abandoned the ship.’

The coastguard asked him to return to the ship to co-ordinate the evacuation. At 1.46am, Schettino received another call. The speaker said: ‘You will return to the boat immediately. You have to tell me how many passengers are left.’

Confusingly, the captain replied: ‘I’m on board, but I’m here.’ The coastguard, who Italian media says understood he had no intention of returning, issued an ultimatum. He said: ‘Captain, this is an order. I am in charge now. There are dead bodies.’

The publication of the transcript comes as Schettino was labelled the ‘most hated man in Italy’. And it precedes the revelation, from a survivor, that men pushed past children who were screaming ‘I don’t want to die’ as the young and elderly were ‘abandoned by the crew’.

The 52-year-old, who lives with wife Fabiola and their 15-year-old daughter at a £175,000 apartment in the small seaside town of Meta di Sorrento near Naples, is at the centre of a Facebook hate campaign after being squarely blamed for the cruise liner running aground.

Thousands have taken to the web to vent their fury at the so-called ‘Captain Coward’, who it is now claimed ‘skimmed’ past the Tuscan isle of Giglio not just to salute a retired officer but also to impress his head waiter’s family on shore.

Many scorned his decision not to remain with his stricken ship. The official death toll rose to seven this morning after another body was pulled from the tilting wreckage. Last night the number of those still unaccounted for rose to 29 – 25 passengers and four crew.

Schettino, who faces up to 12 years in jail for manslaughter, will appear in court today after his company chiefs accused him of an ‘unauthorised and unapproved’ decision to sail so close to the eastern side of the island of Giglio.

The £400million liner, with 4,200 passengers and crew, was sailing just 300 yards from the island’s rocky coast when it should have been at least four miles out to sea. It came to grief on Friday night after sustaining a 160ft gash in the port-side hull.

After swiftly escaping from the listing liner, Schettino – the Concordia’s skipper for six years – was arrested along with first officer Ciro Ambrosio.

The captain was spotted wrapped in a blanket on his way to the shore at around 11.30pm – more than four hours before the evacuation of the vessel was completed – and breaking the maritime tradition of remaining with his ship.

One Italian report said he hailed a taxi and said to the driver: ‘Get me as far away from here as possible’.

Tuscan prosecutor Franco Verusio, who is leading the investigation, said: ‘Captain Schettino was in command. He was the one who ordered that course to be taken, at least according to what we have discovered. There was someone in particular that wanted to be signalled from the ship.’

Schettino gave the order for the doomed sail-by of the island as a ‘salute of respect’ for former Costa commander Mario Palombo, whose parents are from Giglio, it is alleged.

The stunt – as passengers were enjoying dinner at 9.30pm on Friday – was apparently also a favour for the ship’s maître d’ Antonello Tievoli, who lives on the island.

Italian news reports said that that minutes before the Concordia crashed into an underwater reef just two hours into a seven-day Mediterranean cruise, Schettino told the head waiter: ‘Come and look, we are passing over your Giglio.’

After his rescue, Tievoli is understood to have joked: ‘I never thought I would get dropped off at home.’

His 82-year-old father Giuseppe said his son had phoned him before the accident to say the crew would salute him by blowing the ship’s whistle as they passed by.

He said: ‘Antonello called and said that we should look out of the window at around 9.30pm because he would be on the ship and it would pass right by Giglio.  All the ships do it but they never come that close – I was at the window with my wife and, as he said, the ship went past.’

Tievoli’s sister Patrizia, a teacher on the island, made a Facebook post 30 minutes before the disaster saying: ‘Shortly, the Costa Concordia will pass really, really close, a big hello to my brother who will disembark at Savona and finally get to enjoy some holiday.’

Tievoli, 46, has already been questioned by investigators while Palombo, who retired in 2006 because of ill health, is also expected to be interviewed.

But Palombo last night insisted the ‘nautical bow’ was not meant for him as he was not on the island at the time. ‘I have gone to the prosecutor’s office after I was dragged into all this. I’ve been made to feel responsible.’

The stunt of sailing past the island is said to have become something of a tradition for the Concordia. In August, it skirted Giglio sounding its whistle – prompting the mayor to send a congratulatory email to the captain for providing such a ‘spectacle to tourists’.

HEATED EXCHANGE AS CAPTAIN ‘ADMITS HE HAD LEFT SHIP’

The transcripts show heated telephone exchanges took place between captain Schettino and harbour master officials in the hours after he struck the rocks at around 9.40pm on Friday evening.

At 9.49pm Schettino is asked: ‘Is everything ok?’ He replied: ‘Yes, just a small technical problem.’

This was despite the hull having a 70m gash.

There was silence until half past midnight when officials managed to contact the captain – who by now had got off a lifeboat and safely on shore.

Hundreds of passengers were still onboard as the order to abandon ship had only been given an hour earlier.

An official at Livorno harbour asked: ‘How many passengers are left to evacuate captain?’ He answered: ‘I’ve called the company and they say around 40.’

The official, who knew from reports at the scene that hundreds were still onboard, added: ‘How come so few? Are you still onboard captain?’

Captain Schettino replied: ‘No, I’m not onboard, the ship’s beached, we have abandoned.’ To which the shocked official responded: ‘What? You have abandoned ship?’  He answered: ‘No, what are you talking about abandoning.’

Minutes later he was contacted again and told: ‘Get back on board, get back to the ship and co-ordinate the rescue. You need to tell me how many people are onboard, how many women, how many children. You need to organise the rescue.

‘Captain this is an order, I am in charge now, you have given the order to abandon ship and you need to get back to coordinate the rescue, OK. There are already bodies.’

Captain Schettino replied in a whisper: ‘How many?’ with the harbour master shouting at him: ‘You tell me. What do you want to do? Go home? You now get back on board and tell me what you are going to do.’

He replied: ‘Alright, I’m going’. But he failed to obey the order and instead was reportedly seen getting into a taxi which took him from Seagull Point, the reef where the Concordia had beached, to the harbour at Giglio.

A state of emergency has been declared around the stricken vessel after an unidentified liquid began to leak from the ship. Protective barriers have been put in place around the Costa Concordia. Speaking to Sky News, Giglio mayor Sergio Ortelli said: ‘This is an ecological timebomb.

‘I hope that the fuel can be taken off the ship soon and maybe the ship can be removed too because it is hampering navigation.’

The captain has also been accused of dining with beautiful women as the liner crashed into rocks and of raiding the safe before jumping ship.

Monique Maurek, 41, from the Netherlands, said: ‘What scandalised me most was when I saw the captain spending much of the evening before we hit the rocks drinking in the bar with a beautiful woman on his arm.

‘Most people didn’t even have any idea of what the evacuation warning sound would be. It was only because some of us had already been on a cruise that we recognised that seven blasts of the horn was a signal to abandon ship.’

Phil Metcalf, whose daughter Rose was one of the last people off the ship, said she had revealed the captain allegedly abandoned ship in the early stages of the evacuation, leaving his staff onboard.

He said: ‘Since the captain had left there was nobody, so everybody was left to their own devices hence some of the chaos, so obviously the crew took it upon themselves and decided in the absence of the captain to organise and try and help people.’

Prosecutors described Schettino’s handling of the giant craft as ‘inept’ .

Schettino told maritime investigators that charts showed he was in water deep enough to navigate and that he had struck an unidentified rocky outcrop of the island.

Once he realised the extent of the damage he immediately tried to change route and head for the safety of Giglio harbour.

His lawyer, Bruno Leporatti, said Schettino was ‘overcome and wants to express his greatest condolences to the victims’.

But he said Schettino’s actions in anchoring the ship at one end to swing it closer to the shore after the collision, ‘saved the lives of thousands of people’. ‘It could have been an enormous tragedy,’ Mr Leporatti added.

Yesterday, the chief executive of the Italian owner blamed ‘human error’ on the part of the captain for the grounding of the vessel.

Costa Crociere chairman and CEO Pier Luigi Foschi told reporters the liner had passed all safety and technical tests in its 2011 evaluation.

Explaining that the ship was ‘ultra safe’, Mr Foschi said the captain had made an unauthorised and unapproved deviation from the ship’s programmed course.

Mr Foschi said: ‘This route was put in correctly. The fact that it left from this course is due solely to a manoeuvre by the commander that was unapproved, unauthorised and unknown to Costa.’

He added that the company’s main concern was the safety and well-being of the passengers and crew, as well as to ensure fuel doesn’t leak out from the upended hull into the pristine waters off the island of Giglio.

Costa Crociere is a subsidiary of Carnival Cruise lines.

In a statement on Sunday, the company said that the captain, Francesco Schettino, ‘appears to have not followed standard Costa procedures.’

‘The route of the vessel appears to have been too close to the shore,’ it said. Carnival PLC, the owner of the capsized boat, saw its share price plummet by around a fifth.

The allegations against Schettino – all of which were denied by his family – led to him being  dubbed ‘Captain Coward’ by some of the furious survivors who also accused his senior colleagues of abandoning them.

One couple, French military officer Ophelie Gondelle and police officer David Du Pays, said they saw the captain in a lifeboat, covered by a blanket, well before all the passengers were off the ship.

Asked about the suggestion that the captain had abandoned ship, senior prosecutor Francesco Verusio said: ‘Unfortunately, I must confirm that circumstance.’

Friends and relatives of passengers who were on board the cruise liner have turned to social media to search for loved ones and vent their anger and shock at the disaster.

‘My cousin and my niece are still among the missing… someone said they were airlifted out but there are no traces…please let me know if you’ve seen them!” wrote Sabrina Ottaviani on a Facebook forum, above a photo of her relatives.

The special Facebook page dedicated to the Costa Concordia was created after a British dancer who worked on the cruise liner used the social network to urge people to pray for her before she was rescued.

Social networks were buzzing with reaction to the disaster with particularly harsh criticism aimed at the Captain. ‘Shame! To abandon the ship! Shame!,’ wrote one Facebook user, while others formed a group in the captain’s defence.

Twitter users were posting the latest photos and videos of the vessel and keeping track of developments in the rescue.

As an injured crewman and a Korean honeymoon couple were rescued 48 hours after the vessel came to grief, it also emerged that:

■ Survivors were left to swim for their lives and shin down rope ladders during a terrifying ‘Titanic-like’ escape. They told how women and children were barged out of the way by crewmen heading for the lifeboats.

■ Fears grew of an environmental disaster amid claims from the scene that fuel has started leaking from the liner.

■ Rescue divers continue to search submerged parts of the ship before bad weather sinks it fully.

■ All the 35 British passengers and crew on board have been rescued safely and are uninjured.

The crash has shocked all those who enjoy the multi-billion-pound cruise industry and believe they are holidaying in absolute safety.

First Officer Ciro Ambrosio was also arrested and detained with Schettino at Porto Santo Stefano on the Italian mainland before being transferred to prison.

Tuscan chief prosecutor Verusio said the Concordia had ‘very ineptly’ approached the island en route to the port of Savona. The shipping lanes marked on maps plot a course to the west of the island. The Concordia came to grief to the east of Giglio.

Mr Verusio said the ship had struck a reef on its port side causing it to take in an ‘enormous amount of water in a matter of minutes’. A huge piece of rock remained embedded in the hull.

Italian police are conducting two investigations – one into the route the captain took and one into the evacuation of the ship. The 117,000-ton Concordia smashed into rocks two hours into a seven-day Mediterranean cruise as passengers were enjoying dinner at 9.30pm on Friday.

Schettino, who has worked with Concordia for ten years, called his mother Rosa in Naples at 5am and said: ‘There has been a tragedy but keep calm. I tried to save the passengers. I won’t be able to call you for a while but don’t worry.’

His sister Giulia said: ‘We are keeping calm. Franco is a good captain and he has told the truth.’  British dancer Rose Metcalf, who was among the last to be lifted off the ship early on Saturday, said that there was a rumour among staff that the captain had fled with cash.

At the family home in Wimborne, Dorset, her father Philip, 56, said: ‘Other members of staff said that the captain and possibly his first officer left the ship as soon as it hit the rock. They said the captain emptied the safe and fled with the money.

‘She didn’t know if it was true, but if it was she didn’t want him to get away with it. She said that the command structure had broken down and they had to organise the evacuation themselves.’

The nation’s newest Miss America is a 23-year-old Wisconsin brunette who had long conversations with her family mulling whether or not to make her father’s jail time for mail fraud the heart of her campaign in the beauty pageant.

While her competitors pushed platforms including promoting the health benefits of milk and protecting the environment, Laura Kaeppeler (KEP’-ler) said she wants children of incarcerated adults to feel less alone, to have mentoring and as much of a relationship with their parents as possible.

“There are many of you out there — and I was one of them — but it doesn’t have to define you,” Kaeppeler told The Associated Press after winning the crown and $50,000 scholarship on Saturday night.

To win, she said beauty queens and politicians should remember they represent all Americans, sang an opera song and strutted in a white bikini and black evening gown.

Her looks, smarts and personal vocation impressed a panel of seven celebrity judges enough to give her the next year with the title.

“What happened with my father is not what my year is going to be focused on,” she said. “It’s going to be focused on looking forward and moving to the future because that’s what my family has done and that’s what I’ll encourage others to do, as well.”

Kaeppeler estimated that there are more than 2 million children with a parent in jail.

Kaeppeler’s father, Jeff Kaeppeler, told the AP he served 18 months in federal prison for mail fraud, a sentence his daughter said started as she was graduating high school and entering college.

Jeff Kaeppeler said when his daughter approached the family about making the personal topic her chosen platform, they supported it even though they knew it would be discussed publicly.

“It taught us that God can turn anything into good if you let him,” he said. “Laura is totally on board with that idea. She let that drive her and inspire her this past year to get ready for this.

“We’ve seen a miracle,” he said while waiting backstage for a news conference in which his daughter called him her “best friend” and briefly took pictures with him onstage.

“I love you,” he whispered to her as dozens of cameras snapped photos.

Miss Oklahoma Betty Thompson came in second, while Miss New York Kaitlyn Monte placed third.

Kaeppler introduced herself to pageant viewers by referencing her home state’s Green Bay Packers, the NFL’s defending Super Bowl champions.

“If you’re watching, Aaron Rodgers, call me,” she said, referring to the football team’s superstar quarterback.

She was good enough during preliminary competitions to be chosen as one of 15 semifinalists who moved on to compete in the pageant’s finale. Her bid lasted through swimsuit, evening wear, talent and interview competitions that saw cuts after each round.

She was asked minutes before being crowned whether Miss America should declare her politics.

“Miss America represents everyone, so I think the message to political candidates is that they represent everyone as well,” she said. “And so in these economic times, we need to be looking forward to what America needs, and I think Miss America needs to represent all.”

A tribute made up of candles, ballooons, coffee cups, cookies, cigarettes and a gray-white stuffed elephant lies next to the trash enclosure where a serial killer’s fourth victim was stabbed and killed.

Locals in the area who say they knew him, calling him John, came out early Saturday to pay respects and remember the friendly, God-fearing, Santa Claus-like looking man.

Marilyn Holland and Linda Maher shared stories about the mild-mannered Vietnam vet who was known to never ask for money but always got it anyhow.

As Maher drive up in her pickup truck, she called over to Holland, “Was it John?” she asked. “This makes me so mad. I’m so sick about John. He never asked for money. when people gave him money, he always said, ‘God bless you.’”

Holland said she had warned John about the serial killer and had wanted to buy him a cell phone.

“He always liked to sit and drink coffee at Carl’s Jr., read his bible and do crossword puzzles out of the paper. It such a tragedy, he looked just like Santa Claus,” she said. “He was friends with everyone. Even the coyotes in the riverbed, he gave them all names.”

Anaheim police on Friday night arrested a Yorba Linda man identified as Itzcoatl Ocampo, 23, as he ran away shedding clothes after John was stabbed to death behind the fast-food restaurant.

Louis Garcia lives in the Friendly Village Mobile Home Park, where a man had tried to climb a fence as he ran from police and witnesses following the stabbing Friday night. Garcia said more than 100 police were at the scene and a battery of fire trucks. He said he saw the man run from the fast-food restaurant toward the mobile-home park.

That’s when a security guard there pulled him down, Garcia said.

“Within minutes police had him surrounded and sat him down on La Palma Avenue,” Garcia said. “He sat there wearing a red hoodie with his amrms crossed. His face was expressionless.”

Authorities believe the Ocampo is connected to the recent slayings of three other homeless men in north Orange County.

All four victims were stabbed, and Ocampo fits the description of the serial killer captured in a grainy  surveillance video of the Dec. 20 stabbing death of  James McGillivray, a homeless man who was stabbed to death while sleeping outside a Placentia shopping center, authorities said.

A press conference is planned for this afternoon by the serial killer task force, authorities said.

Ocampo was arrested by Anaheim police shortly after another homeless man was stabbed to death about 8:15 p.m. Friday next to a trash enclosure at a Carl’s Jr. restaurant at the intersection of La Palma Avenue and Imperial Highway. That victim, a man in his early 60s, has not been identified.

Several witnesses reported an assault in progress, and officers arrived to find the homeless man dead in the parking lot. Witnesses followed the stabber from the crime scene and pointed him out to responding officers, police said.

Ocampo shed some of his clothes as he ran, according to authorities,  and was arrested a short distance from the trash enclosure. He was uninjured, but had some blood on his body,

A police bloodhound later traced the scent from Ocampo’s belongings back to the scene where the attack occurred, authorities said.

While police have not identified the homeless man stabbed Friday night, several residents say he is a transient known to frequent the shopping center, who they know only as “John.”

Krista Schegetz, a nearby resident, said she had known John for five or six years and often spoke to him and took him food.

“He was very solitary,” Schegetz said. “When I first met him, I asked him if there was anything he needed, and he said ‘I have everything.’ “

Residents said he was a self-described Vietnam veteran who kept to himself, even after the recent homeless killings.

“He was the nicest guy you can imagine,” said Kevin Christensen, who had recently spoken to the man. “I wanted to warn him there was a serial killer loose, and he said ‘Don’t worry about it.’ “

The same killer is believed to have carried out the murders of three middle-aged homeless men in the past several weeks.

McGillivray, 53,  was killed Dec. 20 while sleeping outside a Placentia shopping center. The body of Lloyd Middaugh, 42, was found eight days later on the Santa Ana River Trail in Anaheim. Two days later, Paulus Cornelius Smit, 57, was found dead behind the Yorba Linda library.

The latest victim was discovered about 8:15 p.m. Friday next to a trash enclosure at a Carl’s Jr. restaurant at the intersection of La Palma Avenue and Imperial Highway, Anaheim police Sgt. Bob Dunn said.

Krista Schegetz, a nearby resident, said she had known John for five or six years and often spoke to him and took him food.

Police were also looking for a white, four-door 2000 to 2003 Toyota Corolla seen on video more than an hour before McGillivray was attacked.

Friday’s killing occurred a little more than three miles from the Yorba Linda library, where police and FBI officials Friday afternoon and evening staged roadblocks asking drivers for information about Smit’s death.

The shopping center remained block late Friday night, as investigators let patrons leave after they were interviewed, and bloodhounds were brought in to go over the scene.

Court records show that a man named Itzcoatl Ocampo had three minor  traffiic citations in recent years

Angelina Ortega waited for her son, who had left a voicemail message that he and his girlfriend had witnessed the killing.

“The killer was behind them walking, and then running,” Ortega said of her son’s message.

Authorities urged the homeless to stay vigilant.

“We are certainly not letting our guard down,” Hunter said.

Anaheim Mayor Tom Tait congratulated police on their work in taking the man suspected in the latest death into custody.

“Our thoughts go out to the victims and the homeless community,” Tait said.

Dead: The body of popular teacher Sherry Arnold has been found after she left her home to go running

The Montana math teacher who was found dead today may have been abducted and murdered by men who fled to Dakota.

The FBI have been investigating the possibility that Sherry Arnold, 43, was snatched when she disappeared last weekend and taken out of state.

Police said two men in the Dakotas had been detained for questioning in connection with her death.

Mrs Arnold who has five children with her husband – two of her own, had been missing since January 7th when she left her house for a pre-dawn jog.

The only clue to her disappearance that was publicly released was that one of her shoes was found along her running route, near her home in the oil boom town of Sidney near the North Dakota border.

Sidney Public School officials posted a statement online saying they learned of Mrs Arnold’s death Friday morning. No further information was available.

FBI Special Agent David J. Johnson, of Salt Lake City, said a tip from the public led to the two men.

Frank DiFonzo, Sidney Chief of Police, told old KFYR-TV: ‘Dozens and dozens of tips were called into the tip line by residents of the area. Today as a result of a tip, we are able to announce that a significant breakthrough has occurred.’

Mr DiFonzo said police arrested a man, 47, in Williston and he’s being held in the Williams County Jail. Police in South Dakota are also detaining a man, 22, in Rapid City for questioning.

Karen Arnold Truax of St. Paul, Minn., the daughter of Sherry Arnold’s husband, Gary, told The Billings Gazette the family wants some privacy and ‘time to process what has happened.’

She said: ‘We appreciate everything that everyone did to help us in this search. We are so heartbroken that this is the outcome. We just sincerely appreciate all the love and support that continues to come from the community.’

Only yesterday the victim’s husband, Gary Arnold, told HLN’s Jane Velez-Mitchell that he was hopeful that his wife would be found alive.

He said the disappearance had been ‘very difficult’ on the couple’s children, though they had been trying to stay positive.

Mr Arnold said: ‘Their mother has raised them well. They are troopers, they are hanging in there.’

Matthew Brenner, a senior at the University of Montana, grew up in Sidney and was taught by Mrs Arnold said she was a well-loved woman who was a great teacher and a fixture of the town.

He told KAJ18.com: ‘It’s a shock to me and a shock to them. I don’t even know how to begin to try and start school again, but I can tell you this, she was one of the most respected people in that school system. It’s gonna be rough.’

Donna Brown, resident of Sidney, told KFYR-TV: ‘[It's] very, very sad. Very upsetting.
‘I`m thankful for the community and the family that they did find her. That there can be some closure.’

Sidney Public Schools said that ‘additional counselors were on hand’ to help students cope with the news.

Hundreds of residents, police, firefighters and others combed the town and surrounding countryside earlier this week. The school district played an active role in the search by lending buses to transport members of search teams and setting up a fund to defer expenses.

The disappearance rocked the small town of Sidney, population around 5,000, and located about 100 miles south of the Canadian border – which has been changing rapidly in recent years due to an oil boom.

Christine Mullen, 26, who joined the search effort, even though she didn’t know Mrs Arnold told CNN: ‘We’re such a small community, and crime is absolutely unheard of. We don’t lock our car doors. (We’re) completely shocked.’

Debbie Dujanovic Bertram, an FBI spokeswoman, told FoxNews.com that investigators are ‘looking into all angles’.

Mrs Arnold grew up on a ranch outside Sidney. Her husband also worked for the school and the couple have five children from prior marriages, including two living at home and attending the same school where their mother worked for the past 18 years.

Mr and Mrs Arnold had a mixed family that included at least two children born to her and other children from before their marriage.

Mayor Bret Smelser said the search had covered all of Sidney and surrounding areas of Richland County.

He said federal agents had met with family members, including Arnold’s parents, Ron and Sherry Whited, and pledged to press hard for answers.

‘The promise they made Ron and Sherry was that they wouldn’t give up until they had found something or found Sherry,’ Smelser said.

The Mayor, who attends church with Arnold’s parents, said she is ‘a daughter of the community’ whose disappearance brought out the best in hundreds of residents from Sidney and surrounding towns who have participated in the search.

School superintendent Daniel Farr said Arnold was a mother and devoted algebra teacher who has taught in the Sidney system for 18 years.

‘She’s one of those teachers that every parent wants in front of their child,’ said Mr Farr. ‘She’s there early in the mornings and she’s there after school. She is just a generous and caring person.’

Over the weekend, National Guard troops, a helicopter, several airplanes and canine search teams also took part in the search.

 UPDATE: Man Dies After Getting Caught In Wood Chipper

A man died Thursday morning after getting caught in a wood chipper while trimming trees at a home outside of Nevada City, according to the Nevada County Sheriff’s Department.

The accident happened around 8 a.m. at a home on Indian Shack Road. The victim, identified as Martin Lara, 50 of Applegate,
was part of crew using a large, industrial wood chipper.

Co-workers heard the man scream but could not help him in time.

According to the sheriff’s office, Lara somehow became entangled in a rope that was tied around a bundle of wood and was being pulled by the chipper. He was decapitated apparently either by the rope, clothing or brush and his body was pulled into the cone of the wood chipper but didn’t go all the way in before a co-worker pulled the lever.

“It was definitely a freak accident,” said sheriff’s Sgt. Hap Penaluna.

The company, Bushwackers, had been hired by the homeowner to clear brush.

“I don’t know how that could have happened,” said Jim Norman, owner of Trees Unlimited, who said he planned to talk to his 10 employees in the wake of the accident. “It brings tears to my eyes.”

Heather Locklear was hospitalized on Thursday afternoon after her sister reportedly called 911 for assistance — but a hospital spokeswoman said Friday the “Melrose Place” actress is “out of harm’s way … she is in no danger.”

Paramedics called to Locklear’s Westlake Village home determined she needed hospitalization, TMZreported, adding later that the actress had been awake and responsive when she arrived via ambulance at 2:30 p.m.

She was taken to Los Robles Hospital & Medical Center in Thousand Oaks, where she was listed as “medically stable” on Friday, according to People magazine. “She is in no danger and she’s going to be just fine,” parents Bill and Diane Locklear said in a statement. “Heather’s family wants her fans to know that she is doing well,” a hospital spokeswoman said.

TMZ on Thursday cited law enforcement sources as saying alcohol and prescription drugs were involved, but that report was unconfirmed. Locklear has had issues with alcohol and prescription medications in the past, including a 2008 arrest on suspicion of DUI that was pleaded down to reckless driving.

Locklear and beau Jack Wagner called off their engagement in November, saying they wanted more time to spend with their individual families.

Jorge Martin Benvenuto, the man whose “thrill killing” took a teenage boy’s life and seriously injured a teenage girl, now wants to withdraw his guilty plea because Benvenuto alleges he was not told he had the right to contact the Uruguayan consul after his arrest.

Benvenuto, who faced the death penalty, pleaded guilty in 1998 to capital murder for fatally gunning down Zachary Snarr and attempting to kill Yvette Rodier. The plea bargain resulted in a sentence of life in prison without parole.

A scheduling conference on Benvenuto’s post-conviction petition for habeas corpus is set for today before 3rd District Judge Dino Himonas.

Defense attorney Grant “Bill” Morrison, who was hired by Benvenuto’s family, said there is a provision in the 1963 Vienna Convention signed by the United States and other countries, including Uruguay, for such notification.

“The United States invariably insists on doing that for our nationals when they’re abroad. When they are arrested, the embassy representative is there,” Morrison said.

Morrison said this appears to be a “clear-cut violation” in Benvenuto’s case because he wasn’t informed of this right and because of that, he didn’t contact the consul.

Benvenuto, who was 19 at the time, was legally in the United States on a visa.

The very thought of more court hearings for Benvenuto has Sy Snarr, Zachary Snarr’s mother, reeling.

“When I first heard about it, I felt I had been kicked in the stomach,” Sy Snarr said. “I guess he doesn’t want to be in prison anymore. Well, I don’t want to go to the cemetery anymore.”

The family and prosecutors, who originally sought the death penalty, were satisfied with the sentence of life in prison without parole.

“To have all this dredged up again to me is just unthinkable,” Sy Snarr said. “I’m not even sleeping now.”

Zachary Snarr, an award-winning photographer who was 18 when he died, had gone to take photos of the moon rising above Little Dell Reservoir. He was accompanied by his friend, Yvette Rodier, then also 18, whose married name now is Evans.

Prosecutors say Benvenuto shot Snarr in the head as part of a “thrill killing” and then pumped two more bullets into him. Prosecutors also say Benvenuto shot Rodier three times, but she survived her severe injuries.

Thomas Brunker, of the Utah Attorney General’s Office, has filed a motion to dismiss Benvenuto’s petition, arguing it is too late to make the claim.

The most a consul can do is assure a person’s rights are not violated and ensure he has a lawyer to represent him. Benvenuto had five lawyers, Brunker said.

Benvenuto had four legal defenders who represented him during the plea process, but he later dismissed them, got a private lawyer and then claimed he had been depressed when he entered his guilty plea. That motion was denied on the district court level, it was appealed to the Utah Supreme Court and his conviction was unanimously upheld.

Brunker said a petition such as the latest one Benvenuto has filed would ordinarily go to the district judge who handled it, but 3rd District Judge Anne Stirba is deceased, so it has been assigned to Himonas.

Prosecutors hope the petition will be dismissed at the district court level. But what- ever Himonas decides can be appealed to a higher court.

Robert Stott, of the Salt Lake County District Attorney’s Office who handled the original case, said even if Benvenuto is allowed to withdraw his guilty plea, the original charges would still stand and Benvenuto could possibly face the death penalty.

Morrison, Benvenuto’s lawyer, said his client is aware of these possibilities.

“That’s his choice,” he said. “He’s aware of the risks.”

Meanwhile, Sy Snarr is grappling with feelings she thought she had put to rest through her faith, her family, therapy and supportive people in the community.

“I was consumed with my anger and grief to the point where I couldn’t live, I couldn’t enjoy the rest of my family. I had to let that go because I wanted to be happy again,” she said.

She reached a stage where she could forget Benvenuto, focus on loving her family and cherishing memories of Zach, who would be 27 now.

Benvenuto’s renewed efforts to gain his freedom has upset her family and friends, as well as those of Rodier (Evans), who has a family of her own and is attending law school.

With pain and rage flooding back, Sy Snarr said she must hold on to her confidence in the criminal justice system to do the right thing.

“He says his . . . rights were violated,” she said. “If anybody’s rights were violated, it was Zachary’s.”

The first program in the LIVE TO TELL series, entitled “Full Moon” (4) features Yvette Rodier’s account of a random act of violence that claimed the life of her friend and left her fearing for her life. On the night of Aug. 28, 1996, Yvette and her friend, Zach Snarr, went up to the mountains of Utah for their first date. It was the last moment of peace that Yvette would feel for years. Their special plans to take pictures of the full moon were interrupted when a stranger drove up, pulled out a gun and opened fire, emptying every bullet out of his gun. Zach was killed. Yvette, who was shot four times, survived by pretending to be dead.

Within days of the shooting, authorities caught 19-year-old Jorge Benvenuto. His shocking reason for the attack? For the thrill of watching them die. He even expressed disappointment that one of his victims had survived.

Yvette had indeed lived through the attack and it would take three years and five operations to repair the physical injuries that still left her with permanent nerve damage. But it was the emotional scars that would prove more debilitating. The once trusting and idealistic teenager she had been was gone, in her place was a terrified and isolated girl consumed by the guilt that she had survived.

Despite her fear, Yvette faced her attacker in court. Prosecutors had planned to request the death penalty but as the trial neared Jorge agreed to a plea bargain in exchange for life in prison. But Yvette’s emotional torment would continue for years as Jorge filed appeals.

Jorge lost his most recent appeal in 2007. And 14 years after that fateful night, Yvette Rodier, now a mother to a 7-year-old daughter and a lawyer working with the victims of crimes, says that she still thinks of Zach everyday but that she is grateful that she lived to tell her story.

Only a few days old and young Blue Ivy Carter has already clocked in a duet with her big poppa. On Monday (January 9), Jay-Z dropped “Glory” featuring B.I.C. on his Life and Times blog.

Over a simple but soulful loop, Jay dedicates his bars to he and Beyoncé‘s newborn daughter. “The most amazing feeling I feel/ Words can’t describe the feeling, for real/ Baby I’ll paint the sky blue/ My most greatest creation was you,” Hov begins over the Pharrell-produced track.

For the heartfelt dedication, Jigga employs a slow flow, rhyming almost as if in spoken word. The measured pace only helps to intensify the emotion. Hov goes on to rhyme about the “false alarms” and “false start” that he and B faced leading up to the birth of the couple’s first child. As guarded as Jay has been throughout the entire pregnancy, he opens about the couple’s intimate moments, painting a picture of Baby Blue dancing in B’s belly and then playfully asking, “Did you wiggle your hands for her?”

The Brooklyn-bred MC goes on to look back on his own troubled past, wishing that he had prayed more, but seemingly thankful that all of the drama of his drug-dealing past is behind him so he could enjoy the moment. “A younger, smarter, faster me,” he describes his new bundle of joy.

Jay-Z goes even deeper and doesn’t hold back. In the song’s final verse, he tells little Ms. Blue Ivy of her grandfather’s demise, telling her that despite being an absentee father, “deep down” Adnis Reeves was “a good man.” Jay goes on to tell his baby girl that she was conceived in Paris and even opens up about a “miscarriage.”

And he doesn’t hold back when he delivers a healthy brand of lyricism, spitting, “You’re my child with the child from Destiny’s Child/ That’s a hell of a recipe.”

As the song fades out, baby Blue Ivy makes her first appearance on record, crying and cooing as Pharrell brings the drums and soul sample to a close. Glorious.

Edgar Cayce (1877-1945) has been called the “sleeping prophet,” the “father of holistic medicine,” and the most documented psychic of the 20th century. For more than 40 years of his adult life, Cayce gave psychic “readings” to thousands of seekers while in an unconscious state, diagnosing illnesses and revealing lives lived in the past and prophecies yet to come. But who, exactly, was Edgar Cayce?

Cayce was born on a farm in Hopkinsville, Kentucky, in 1877, and his psychic abilities began to appear as early as his childhood. He was able to see and talk to his late grandfather’s spirit, and often played with “imaginary friends” whom he said were spirits on the other side. He also displayed an uncanny ability to memorize the pages of a book simply by sleeping on it. These gifts labeled the young Cayce as strange, but all Cayce really wanted was to help others, especially children.

Later in life, Cayce would find that he had the ability to put himself into a sleep-like state by lying down on a couch, closing his eyes, and folding his hands over his stomach. In this state of relaxation and meditation, he was able to place his mind in contact with all time and space — the universal consciousness, also known as the super-conscious mind. From there, he could respond to questions as broad as, “What are the secrets of the universe?” and “What is my purpose in life?” to as specific as, “What can I do to help my arthritis?” and “How were the pyramids of Egypt built? His responses to these questions came to be called “readings,” and their insights offer practical help and advice to individuals even today.

Many people are surprised to learn that Edgar Cayce was a devoted churchgoer and Sunday school teacher. At a young age, Cayce vowed to read the Bible for every year of his life, and at the time of his death in 1945, he had accomplished this task. Perhaps the readings said it best, when asked how to become psychic, Cayce’s advice was to become more spiritual.

Although Cayce died more than 60 years ago, the timeliness of the material in the readings — with subjects like how to discovering your mission in life, developing your intuition, exploring ancient mysteries, and taking responsibility for your health — is evidenced by the hundreds of books that have been written on the various aspects of this work as well as the dozen or so titles focusing on Cayce’s life itself. Together, these books contain information so valuable that even Edgar Cayce himself might have hesitated to predict their impact on the contemporary world. In 1945, the year of his passing, who could have known that terms such as “meditation,” “Akashic records,” “spiritual growth,” “auras,” “soul mates,” and “holistic health” would become household words to millions?

The majority of Edgar Cayce’s readings deal with holistic health and the treatment of illness. As it was at the time Cayce was giving readings, still today, individuals from all walks of life and belief receive physical relief from illnesses or ailments through information given in the readings — some readings were given as far back as 100 years ago! Yet, although best known for this material, the sleeping Cayce did not seem to be limited to concerns about the physical body. In fact, in their entirety, the readings discuss an astonishing 10,000 different topics. This vast array of subject matter can be narrowed down into a smaller group of topics that, when compiled together, deal with the following five categories: (1) Health-Related Information; (2) Philosophy and Reincarnation; (3) Dreams and Dream Interpretation; (4) ESP and Psychic Phenomena; and (5) Spiritual Growth, Meditation, and Prayer.

Edgar Cayce was an American who claimed to be a psychic. He had demonstrated an ability to channel answers to questions on subjects such as health or Atlantis, while in a self-induced trance. Though Cayce considered himself a devout Christian and lived before the emergence of the New Age Movement, some believe he was the founder of the movement and had influence on its teachings.

Cayce became a celebrity toward the end of his life and the publicity given to his prophecies has overshadowed what to him were usually considered the more important parts of his work, such as healing (the vast majority of his readings were given for people who were sick) and theology (Cayce was a lifelong, devout member of the Disciples of Christ). Skeptics challenge the statement that Cayce demonstrated psychic abilities, and traditional Christians also question his unorthodox answers on religious matters (such as reincarnation and Akashic records).

1877 to 1920—the Kentucky period

In December 1893, the Cayce family moved to Hopkinsville, Kentucky and occupied 705 West Seventh, on the south-east corner of Seventh and Young Street. During this time, Cayce received an eighth-grade education; discovered his spiritual vocation; left the family farm to pursue various forms of employment (at Richard’s Dry Goods Store and then in Hopper’s Bookstore, both located on Main Street).

Cayce’s education stopped with the ninth grade because his family could not afford the costs involved. A ninth-grade education was often considered more than sufficient for working-class children. Much of the remainder of Cayce’s younger years would be characterized by a search for both employment and money.

Throughout his life, Cayce was drawn to church as a member of the Disciples of Christ. He read the Bible once for every year of his life, taught at Sunday school, and recruited missionaries, and he is said to have agonized over the issue of whether his supposed psychic abilities—and the teachings which resulted—were spiritually legitimate.

In 1900, he formed a business partnership with his father to sell Woodmen of the World Insurance but was struck by severe laryngitis in March that resulted in a complete loss of speech. Unable to work, he lived at home with his parents for almost a year. He then decided to take up the trade of photography, an occupation that would exert less strain on his voice. He began an apprenticeship at the photography studio of W.R. Bowles in Hopkinsville.

A traveling stage hypnotist and entertainer called “Hart—The Laugh Man” was performing at the Hopkinsville Opera House in 1901. He heard about Cayce’s condition and offered to attempt a cure. Cayce accepted, and the experiment took place on stage in front of an audience. Remarkably, Cayce’s voice apparently returned while in a hypnotic trance but allegedly disappeared on awakening. Hart tried a posthypnotic suggestion that the voice would continue to function after the trance, but this proved unsuccessful.

Since Hart had appointments at other cities, he could not continue his hypnotic treatment of Cayce. However, a local hypnotist, Al Layne, offered to help Cayce in restoring his voice. Layne suggested that Cayce describe the nature of his condition and cure while in a hypnotic trance. Cayce described his own ailment from a first person plural point of view (“we”) instead of the singular (“I”). In subsequent readings he would generally start off with “We have the body.” According to the reading, his voice loss was due to psychological paralysis and could be corrected by increasing the blood flow to the voice box. Layne suggested that the blood flow be increased, and Cayce’s face supposedly became flushed with blood and his chest area and the throat turned bright red. After 20 minutes Cayce, still in trance, declared the treatment over. On awakening, his voice was alleged to have remained normal. Relapses were said to have occurred but were said to have been corrected by Layne in the same way, and eventually the cure was said to be permanent.

Layne had read of similar hypnotic cures effected by the Marquis de Puységur, a follower of Franz Mesmer, and was keen to explore the limits of the healing knowledge of the trance voice. He asked Cayce to describe Layne’s own ailments and suggest cures and reportedly found the results both accurate and effective. Layne suggested that Cayce offer his trance healing to the public, but Cayce was reluctant. He finally agreed on the condition that readings would be free. He began with Layne’s help to offer free treatments to the townspeople. As his success and fame spread, he became known as “The Miracle Worker of Virginia Beach.” Reports of Cayce’s work appeared in the newspapers, inspiring many postal inquiries. Cayce was able to work just as effectively using a letter from the individual as with having the person present. Given the person’s name and location, he said he could diagnose the physical and/or mental conditions and provide a remedy. He became popular and soon people from around the world sought his advice through correspondence.

Cayce’s work grew in volume as his fame grew. He asked for voluntary donations to support himself and his family so that he could practice full time. He continued to work in an apparent trance state with a hypnotist all his life. His wife and eldest son later replaced Layne in this role. A secretary, Gladys Davis, recorded his readings in shorthand.

1920 to 1923—the Texas period

The growing fame of Cayce coupled with the popularity he received from newspapers attracted several eager commercially minded men who wanted to seek a fortune by using Cayce’s clairvoyant abilities. Even though Cayce was reluctant to help them, he was persuaded to give the readings, which left him dissatisfied with himself and unsuccessful. A cotton merchant offered Cayce a hundred dollars a day for his readings about the daily outcomes in the cotton market. However, despite his poor finances, Cayce refused the merchant’s offer. Others wanted to know where to hunt for treasures; some wanted to know the outcome of horse races. Several times he was persuaded to give the readings as an experiment. However, he was not successful when he used his ability for such purposes, doing no better than chance alone would dictate. These experiments allegedly left him depleted of energy, distraught, and unsatisfied with himself. Finally, he came to the conclusion that he would use his gift only to help the distressed and sick.

He was persuaded to give readings on philosophical subjects in 1923 by Arthur Lammers, a wealthy printer who, by his own admission, had been “studying metaphysics for years”. While in his supposed trance state, Cayce was told by Lammers that he spoke of Lammer’s past lives and of reincarnation, something Lammers believed in, which was a popular subject of the day but not an accepted part of Christian doctrine. Cayce questioned his stenographer as to what he had said in his trance state and remained unconvinced. Cayce himself challenged Lammers’s charge that he had validated astrology and reincarnation in the following dialog:

Cayce “I said all that?…I couldn’t have said all that in one reading.” “No,” Lammers said; “but you confirmed it. You see, I have been studying metaphysics for years, and I was able by a few questions, by the facts you gave, to check what is right and what is wrong with a whole lot of the stuff I’ve been reading. The important thing is that the basic system which runs through all the mystery religions, whether they come from Tibet or the pyramids of Egypt, is backed up by you. It’s actually the right system.”  Cayce’s stenographer recorded the following:

“In this we see the plan of development of those individuals set upon this plane, meaning the ability to enter again into the presence of the Creator and become a full part of that creation.
Insofar as this entity is concerned, this is the third appearance on this plane, and before this one, as the monk. We see glimpses in the life of the entity now as were shown in the monk, in this mode of living.
The body is only the vehicle ever of that spirit and soul that waft through all times and ever remain the same.”

Cayce was quite unconvinced (that he had been referring to and, as such, had validated the doctrine of reincarnation), and the best Lammers could offer was that the reading “opens up the door” and went on to share his beliefs and knowledge of the “truth” with Cayce.  It appeared Cayce’s instincts were telling him this was no ordinary reading. This client who came for a reading came with quite a bit of information of his own to share with Cayce and seemed intent upon convincing Cayce, now that he felt the reading had confirmed his strongly held beliefs. It should be noted, however, that 12 years earlier Cayce had briefly alluded to reincarnation. In reading 4841-1, given April 22, 1911, Cayce referred to the soul being “transmigrated.” Because, as noted below, there are several thousand missing Cayce readings from the period up to 1923, it is possible that he may have also mentioned reincarnation in other readings as well.

Cayce reported that his conscience bothered him severely over this conflict. Lammers overwhelmed, manipulated, confused, reassured and argued with Cayce. Ultimately his “trance voice,” the “we” of the readings, also supposedly dialogued with Cayce and finally persuaded him to continue with these kinds of readings. In 1925 Cayce reported that his “voice” had instructed him to move to Virginia Beach, Virginia.

1925 to 1945—the Virginia Beach period

Cayce’s mature period, in which he created the several institutions which would survive him in some form, can be considered to have started in 1925. By this time he was a professional psychic with a small staff of employees and volunteers. The “readings” increasingly came to involve occult or esoteric themes.

Cayce gained national prominence in 1943 through a high-profile article in Coronet titled “Miracle Man of Virginia Beach”. He said he couldn’t refuse people who felt they needed his help, and he increased the frequency of his readings to eight per day to try to make an impression on the ever-growing pile of requests. He said this took a toll on his health as it was emotionally draining and often fatigued him. He even went so far as to say that the readings themselves scolded him for attempting too much and that he should limit his workload to just two readings a day or else they would kill him.

Edgar Cayce suffered from a stroke and died on January 3, 1945. He is buried in Riverside Cemetery in Hopkinsville, Kentucky.

Claimed psychic abilities

Edgar Cayce has variously been referred to as a “prophet” (cf. Jess Stearn‘s book, The Sleeping Prophet), a “mystic“, a “seer”, and a “clairvoyant“.

Cayce’s methods involved lying down and entering into what appeared to be a trance or sleep state, usually at the request of a subject who was seeking help with health or other personal problems (subjects were not usually present). The subject’s questions would then be given to Cayce, and Cayce would proceed with a reading. At first these readings dealt primarily with the physical health of the individual (physical readings); later readings on past lives, business advice, dream interpretation, and mental or spiritual health were also given.

Until September 1923, they were not systematically preserved. However, an October 10, 1922, Birmingham (Alabama) Age-Herald article quotes Cayce as saying that he had given 8,056 readings as of that date, and it is known that he gave approximately 13,000-14,000 readings after that date. Today, only about 14,000 are available at Cayce headquarters and on-line. Thus, it appears that about 7,000-8,000 Cayce readings are missing.

When out of the trance he entered to perform a reading, Cayce said he generally did not remember what he had said during the reading. The unconscious mind, according to Cayce, has access to information which the conscious mind does not — a common assumption about hypnosis in Cayce’s time. After Gladys Davis became Cayce’s secretary on September 10, 1923, all readings were preserved and his wife Gertrude Evans Cayce generally conducted (guided) the readings.

Cayce said that his trance statements should be taken into account only to the extent that they led to a better life for the recipient. Moreover, he invited his audience to test his suggestions rather than accept them on faith.

Other abilities that have been attributed to Cayce include astral projection, prophesying, mediumship, viewing the Akashic Records or “Book of Life“, and seeing auras. Cayce said he became interested in learning more about these subjects after he was informed about the content of his readings, which he reported that he never actually heard himself.

The health readings are most numerous, and they involve many alternative health concepts and practices. Cayce described his work in terms of Christian service. People with esoteric interests have focused on a somewhat different set of topics.

  • Origin and destiny of humanity: “All souls were created in the beginning, and are finding their way back to whence they came.” [Reading 3744-5] The Cayce readings could be interpreted as saying that human souls were created with a consciousness of their oneness with God. Some “fell” from this state; others—led by the Jesus soul—volunteered to save them. The Earth, with all its limitations, was created as a suitable arena for spiritual growth. It could also be interpreted as saying that all beings are born and all will eventually die.
  • Reincarnation: Cayce’s work teaches the reality of reincarnation and karma, but as instruments of a loving God rather than blind natural laws. Its purpose is to teach us certain spiritual lessons. Animals have undifferentiated, “group” souls rather than individuality and consciousness. Humans have never been incarnated as animals. He describes a very complex design arranged between souls and God to “meet the needs of existing conditions”, which was a reference to the souls who became entrapped in the Earth’s physical materiality, which was not intended for a habitat of the soul. In There Is A River, a biography about Cayce by Thomas Sugrue, we are told by Sugrue that spirit “thought-forms” stayed near and guided the anthropoid ape which was chosen to be the most ideal vehicle for the human physical race to be created from, and psychically guided their separate evolution into a Homo sapiens species. This contradicts Cayce’s view. In reading (3744-5), Cayce states “Man DID NOT descend from the monkey, but man has evolved, resuscitation, you see, from time to time, time to time, here a little, there a little, line upon line and line and line upon line.” Cayce’s view arguably incorporates and parallels Theosophical teachings on spiritual evolution.
  • Astrology: Cayce accepts astrology on the basis that our souls spend time on other planets (or perhaps their spiritual counterparts) in between incarnations. The position of the planets at our birth records these influences.
  • Universal laws: Souls incarnated on the Earth are subject to certain spiritual laws such as, “As ye sow, so shall ye reap” (karma) or “As ye judge (others), so shall ye be judged.” Properly regarded, such laws represent an aspect of God’s mercy whereby no matter what our circumstances, He has promised to guide us in our spiritual path. Cayce said that when you view it from the highest dimension, there is no time and no space, nor any future or past, and that it is all happening in one fascinating expression and that time is an illusion that has purpose.
  • Unknown Life of Jesus: Cayce presented narratives of Jesus’ previous incarnations, including a mysterious Atlantean figure called “Amilius” as well as the more familiar biblical figures of Adam, Enoch, Melchizedek, Joshua, Asaph, and Jeshua. Cayce describes Jesus as an Essene who traveled to India in his youth in order to study Eastern religions, more specifically astrology.
    • Jesus and Christ: Following New Thought precedent, Cayce distinguishes between Jesus and Christhood. Briefly, Jesus was a soul like us who reincarnated through many lifetimes. “Christhood” is something he was the first to allow to be “manifest” through his material life, and it is something which we also ought to aspire towards. Cayce accordingly calls Jesus our “elder brother” and frequently makes reference to the way of the “lowly Nazarene.”
  • Ideals: Cayce repeatedly stresses the choice of an ideal as the foundation of the spiritual path. “And O that all would realize… that what we are… is the result of what we have done about the ideals we have set” (1549-1). We may choose any ideal we feel drawn to. As we attempt to apply it in our lives, God will guide us further, perhaps inspiring us to revise our choice of ideal. The highest ideal, says Cayce, is Christ; however, the readings recognize “the Christ spirit” in some form as the basis for religions other than Christianity.
  • Body, Mind, Spirit: Cayce often invokes these three terms, or their equivalents, to describe the human condition. “Spirit is the life. Mind is the builder. Physical is the result.” (conflation of various readings). The concept has application not only to holistic health but also to the spiritual life.
  • Meditation: While Cayce sometimes described particular meditation techniques of sitting or chanting “Arrr–eee-oommm” the crucial element, he believed, is that of opening up to divine influences. The Search For God books say that “Through prayer we speak to God. In meditation, God speaks to us.” Cayce’s concept of meditation has some aspects in common with Hinduism or Buddhism (the chakras, kundalini) but is most similar to Christian versions of New Thought. The symbolism of the Book of Revelation, he says, is based on meditative experiences.
  • Extra-sensory perception: Cayce accepted psychic experiences and ESP as a natural by-product of soul growth. God may speak to us through dreams (many readings consist of dream interpretation), or through intuitions similar to the pangs of conscience. However, Cayce did not endorse Spiritualism or mediumship on the grounds that supposed entities thus contacted are not necessarily particularly lofty. Instead, he encouraged seekers to focus on Christ.
  • Atlantis: The Cayce readings spoke of the existence of Atlantis, a legendary continent with an advanced technology whose refugees peopled ancient Egypt as well as pre-Columbian America. Cayce’s description of Atlantis has much in common with that of Ignatius L. Donnelly. According to Cayce, Atlantean society was divided into two long-lived political factions—a “good” faction called the “Sons of the Law of One,” and an “evil” faction called the “Sons of Belial.” Many people alive today are the reincarnations of Atlantean souls, he believed, who must now face similar temptations as before. It is said Atlantis suffered three major destructions, one of which was the deluge. According to the readings, a major source of turmoil was the Sons of Belial’s desire to exploit the Things, sub-humans with animal appendages and low intelligence, and the movements to protect and evolve them by the Sons of the Law of One. The final destruction was the overcharging of the crystal which caused a massive explosion.
  • Egypt: Next to biblical times, the most significant era for the “life readings” was a pre-dynastic Egyptian civilization consisting of Atlantean refugees. Cayce purported to have been an Egyptian priest named “Ra Ta” who built a spiritually-based healing center (the “Temple of Sacrifice”) and educational institution (the “Temple Beautiful”). His diagnostic readings and narratives about the past and future were supposed to be a continuation of his ancient work. This civilization also built monuments on the Giza plateau, including the Great Pyramid, and left records of Atlantis in a “hall of records” located somewhere beneath the Great Sphinx of Giza. These readings bear a close resemblance to books by AMORC founder H. Spencer Lewis.
  • Earth Changes: Cayce coined the term Earth Changes (later widely used in New Age writings), a reference to a series of cataclysm events which he prophesied would take place in future decades — notably including the Earth shifting on its axis, and most of California dropping into the Pacific Ocean following a catastrophic earthquake.
  • Cayce “cures”: Cayce’s medical readings typically prescribe poultices (often of castor oil), osteopathic adjustments, colonic irrigation, massage (often with peanut oil), prayer, folk remedies (e.g. charcoal tablets), various forms of electric medicine and patent medicines (such as Atomidine), and specific recommendations concerning diet and exercise. Cayce is often seen as a practitioner of holistic medicine, and has particularly strong philosophical ties with naturopathy.
  • “Cayce diet”: Major dietary recommendations include the avoidance of red meat, alcohol (except red wine), white bread, and fried foods; a preference for fruits and above-ground, leafy vegetables over starches; and a high ratio (80:20%) of alkaline foods over acidic. One meal per day should consist entirely of raw vegetables. Under strict circumstances, Cayce advocated both coffee and pure tobacco cigarettes to be non-harmful to health. “Food combining” was also a central idea in the Cayce diet. According to Cayce, several food combinations that are contraindicated are coffee with milk or sugar, citrus fruit with starchy foods, and high protein foods with starches. Cayce himself followed very few of the dietary recommendations that were suggested by the readings. According to Cayce, two or three almonds (see Amygdalin) a day keeps cancer away.
  • Dream interpretation: Cayce was one of the early dream interpreters who contradicted Freudian views by saying that dreams can be of many different kinds (including sexual) with many levels of meaning; that lack of interest is the reason for poor dream recall; that only the dreamer knows the meaning of his dream; and that a dream is correctly interpreted when it makes sense to the dreamer, when it checks out with his other dreams, and when it moves him forward in his life.

American mystic known as “The Sleeping Prophet.” While in a sleep state he could discuss history, geology, metaphysics, philosophy and medicine. He gave approximately 30,000 life-readings and medical diagnosis to people during his lifetime. He founded a hospital, a university and the A.R.E. (Association for Research and Enlightenment) in Virginia Beach, Virginia that promotes research on his readings and continues his work.

Edgar Cayce was born to uneducated farming parents. He attended country school only as far as the eighth grade. As a child he had a strong desire to become a preacher, which he never formally realized. He prayed to be able to help others, especially children, and had a spiritual vision in 1890, at age 13, that told him he would be able to accomplish this dream of service. A lady bathed in light told Cayce to sleep with his head on his books, and then he would be able to remember what was in them. This was at a time when he was having trouble in school, and his father was apparently beating him for not being able to spell the words in his lessons correctly. Soon after, he showed signs of special abilities when he found that he could sleep on his school books and have photographic recall of every page, and he seems to have continued using this

ability throughout his early life– such as when he got a job at an office supply and book store after having first been turned away, by demonstrating to the owners that he was more familiar with their catalog and inventory than they were.

On 3/16/1886 Cayce had his first vision. Two years later he was pronounced dead from drowning, but recovered. In 1900 he developed a severe case of laryngitis that doctors couldn’t cure. In desperation he tried hypnosis from a traveling practitioner and was cured after several treatments. Under hypnosis, he gave his first psychic reading on 3/31/1901 and learned that he could give accurate medical diagnoses and healing recommendations for himself and for other people. Requests for his readings increased by word-of-mouth.

Cayce married Gertrude Evans, his first serious girlfriend, after eight years of courtship on 6/17/1903. Their first child, son Hugh Lynn, was born on 3/16/1907 and his second son, Milton Porter, was born in 3/28/1911 and died 5/17/1911. Gertrude, weakened with grief, became ill with tuberculosis, and was cured by following the recommendations in her husband’s readings for her. Hugh Lynn’s eye was severely burned in an accident with photo flash powder in Cayce’s studio. Readings for him proved successful as well. On 2/08/1918 his third son, Edgar Evans, was born.

Two tragic fires plagued his photographic work; one occurred on 12/23/1906 and destroyed his studio and many paintings and works of art he had at the studio for a show and the other destroyed his new studio in September 1907.

By 1910, Cayce was receiving a great deal of publicity, particularly as a result of a New York Times article. He began giving readings in Hopkinsville as a “psychic diagnostician.” At the same time, he operated his own photographic studio to support his family. The work with the readings progressed to the point where a full-time secretary was needed to record and transcribe the readings. Gladys Davis was hired in 1923 to perform that function. The family, with Gladys, moved to Dayton, Ohio later that year and Cayce began giving readings on a full-time basis. He established the Cayce Psychic Institute and began to give his first life readings, citing information on past lives of the inquirers, and other metaphysical topics in addition to the health readings.

In 1924, Cayce met a wealthy New York stockbroker who agreed to fund his work. They planned a national organization that would be called the Association of National Investigators. The readings recommended that the organization be located in Virginia Beach where a hospital was to be built, so the family moved there. The dream of the hospital was realized with its opening in 1927. Atlantic University opened in 1930 to study the readings and provide a college education. Hard times hit when funding was withdrawn and the hospital closed in February 1931. The Association of National Investigators disbanded that same year. Cayce was distraught, but a group of loyal supporters urged him to for a new organization, called the Association for Research and Enlightenment (A.R.E.), in Virginia Beach.

Cayce, his wife Gertrude and secretary Gladys Davis were arrested on charges of fortune-telling during a visit to New York in 1931, but the charges were dismissed. Four years later, Cayce, his son Hugh Lynn, and his stenographer were arrested in Detroit for practicing medicine without a license as a result of giving a reading for a sick child. Edgar was convicted and freed on probation.

More publicity came in 1943 with the publication of the Cayce biography, “There is a River” by Thomas Sugrue, and a Coronet magazine article, “Miracle Man of Virginia Beach.” Heavy mail requests for readings deluged the A.R.E. Cayce struggled to keep up with the workload, giving many more readings than usual each day, against the advice of his own readings. His last reading of over 30,000 was given on 9/17/1944. He suffered a stroke and final illness and died on 1/03/1945 at 7:15 PM EWT in Virginia Beach. A few hours before dying, he roused from his sleep and said, “How much the world needs God today.” His wife, Gertrude, died three months later on Easter Sunday, 4/01/1945, at sunrise. His mother died 25/10/1926; father died 11/04/1937.

Throughout his life, Cayce claimed no special abilities and did not capitalize financially or otherwise on his gifts. The readings never offered a set of beliefs or “religion” to be embraced, but instead focused on the idea that every person should test in his or her own life the principles presented. Though Cayce was a devout Christian who read the Bible through once for every year of his life, his work emphasized the importance of comparative study of belief systems from around the world. In fact, some of the metaphysical material that came through the sleeping Cayce was at first confusing and distressing to him in his waking state. However, he overcame his doubts, as have others, by observing the amazing accuracy and unfailing helpfulness of the readings in other areas, such as healing. For some, the Christian language of the readings is at first an obstacle. Yet, the underlying principle of the readings is the oneness of all life, acceptance of all people, and a compassion and understanding for every major religion in the world.

Elle Fanning, breakout star of J.J. Abrams’ summer hit Super 8, continues to line up interesting acting projects. Dakota’s kid sister soon will be seen in Cameron Crowe’s We Bought a Zoo, alongside Matt Damon and Scarlett Johansson. AndDeadline now reports that Fanning has been tapped to star in Bomb, a period drama written and directed by Sally Potter (OrlandoYes).Fanning would play a Cold War-era teenager caught up in her own personal struggle to save the world from nuclear annihilation, though her efforts cause serious rifts within her own family unit. Potter already has cast Alessandro Nivola for the film. He’ll star as an open-minded- charming writer (read: hippie) who enrages his teenager daughter by sleeping with her best friend. Come on, girl! A Florida man, arrested Saturday for allegedly plotted to bomb night clubs and the sheriff’s headquarters in Tampa, Florida, faces a federal judge on a terror charge Monday afternoon, federal prosecutors said.

Sami Osmakac, a 25-year-old naturalized American born in Kosovo, planned a car bombing that would be followed by hostage-taking and the explosion of a suicide belt he planned to wear, according to a criminal complaint made public Monday.

“We all have to die, so why not die the Islamic way?” Osmakac allegedly told an undercover FBI employee, according to the complaint.

The federal investigation of Osmakac began in September when a “confidential human source” told the FBI that Osmakac, a resident of Pinellas Park, Florida, “asked for al Qaeda flags,” the complaint said.

A law enforcement official, who asked not to be identified because the official was not authorized to talk about the probe, said the suspect does not appear to have any ties to al Qaeda, and early information indicated he was “self-radicalized.”

“I don’t have any indication anyone else was involved in the plot and pushing this,” the official said.

By November, the suspect was discussing potential terror targets in Tampa and asked for the confidential source’s help in getting guns and explosives for the attacks, the complaint said.

The government’s source introduced Osmakac to an undercover FBI employee, which led to a December 21 meeting during which the suspect said “he wished to acquire an AK-47-style machine gun, Uzi submachine guns, high capacity magazines, grenades and an explosive belt,” the complaint said. He later allegedly gave the FBI employee a $500 down payment for the weapons, it said.

“The explosives and firearms that he allegedly sought and attempted to use were rendered inoperable by law enforcement and posed no threat to the public,” the government said.

Osmakac, in a New Year’s Day meeting with the undercover FBI employee, outlined his plot, it said. His alleged bomb targets were “night clubs in the Ybor City area of Tampa, the operations center of the Hillsborough County Sheriff’s Office in Ybor City and a business in the South Tampa area of Tampa,” the government said.

After the car bombing, he would retrieve guns and explosives stashed in a Tampa hotel room to begin the second phase of his attacks, the complaint said.

He told the FBI employee that “he wanted to use the explosive belt to ‘get in somewhere where there’s a lot of people’ and take hostages,” the complaint said. He would then demand that the FBI “release some prisoners,” it said.

“Once I have this … they can take me in five million pieces,” he allegedly said, “an apparent reference to the explosive belt that would be attached to his waist,” the government said.

FBI agents arrested Osmakac Saturday night, just after he “made a video of himself explaining his motives for carrying out the planned violent attack,” the government said.

He is scheduled to make an initial appearance before U.S. Magistrate Judge Anthony Porcelli in Tampa at 2 p.m. Monday on one count of attempted use of a weapon of mass destruction.

“This investigation was also predicated, in part, by assistance from the Muslim community,” U.S. Attorney Robert E. O’Neill said.
